Alina Habba has stepped down as the chief federal prosecutor in the state. This decision was prompted by a court battle that invalidated her legal standing to occupy the role.

Acceptance of Resignation

The head of the Justice Department, Pam Bondi, accepted the prosecutor's departure on Monday. In a statement that the judicial decision made it "untenable" for Habba to effectively run her office.

"Let no one confuse following the order as giving up," she wrote. "The effort will now reach across America."

Her resignation comes a week after a US appeals court found that she had been serving in violation of the law as the top prosecutor. This ruling is likely to affect many criminal cases in the Garden State.

The court declared that a interim role that skirted the advice and consent of the Senate breached the statute on vacant positions.
